What do I need for a Notarization? style="enable-background:new 0 0 13 15;" xml:space="preserve"> style="enable-background:new 0 0 12.9 2;" xml:space="preserve">

The basic elements to any notarization are that all signing participants are present, with acceptable ID, and willing to complete the signing. These are non-negotiable and a notarization will not take place if these few conditions can not be met. What are the ID requirements? style="enable-background:new 0 0 13 15;" xml:space="preserve"> style="enable-background:new 0 0 12.9 2;" xml:space="preserve">
Acceptable Identification Documents. A Notary may accept current identification documents from the list below as satisfactory evidence of a document signer's identity (57 Pa. C.S. 307[b]):
  • U.S. passport or passport card
  • Foreign passport (providing the Notary can read and understand it).
  • Driver's license or non-driver ID card issued by a U.S. state.
  • Driver's license or non-driver ID card issued by Canada or Mexico (providing the Notary can read and understand it)
  • Other form of government identification providing it is current and contains a signature or photograph.
  • Discretion. A Notary may require additional information or identification to assure the identity of the individual (57 Pa. C.S. 307[c).
  • Unacceptable Identification Documents. - Birth certificates, while issued by the government, do not bear a photograph or signature of the individual named in it.
  • Credit cards, while they bear signatures and may contain a photograph of the individual, these are not issued by the government.
What is a Credible Identifying Witness? style="enable-background:new 0 0 13 15;" xml:space="preserve"> style="enable-background:new 0 0 12.9 2;" xml:space="preserve">
When a document signer is not personally known to the Notary and is not able to present a reliable ID card, that signer may be identified on the oath or affirmation of a credible identifying witness (57 Pa. C.S. 307[b|[2]).
 
Qualifications: Pennsylvania law requires that a credible identifying witness be present at the time of the notarization, be personally known to both the Notary and the signer and swear or affirm to the Notary that the signer is the person whom the signer claims to be (57 Pa. C.S. 307[bl[2|).
 
Pennsylvania's requirements for credible identifying witnesses create a chain of personal knowledge from the Notary to the witness to the signer. Therefore, the credible identifying witness must personally know the Notary as well as the document signer (57 Pa. C.S. 307[b][2])
 
Pennsylvania Notaries should administer an oath or affirmation to the credible identifying witness. The credible identifying witness should swear or affirm that the following is true:
 
The individual appearing before the Notary is the person named in the document.
 
The credible witness personally knows the signer.
 
The credible witness believes the signer does not possess an authorized ID card.
 
The credible witness believes it would be very difficult or impossible for the signer to obtain another form of ID.
 
The credible witness does not have a direct or financial interest in the record being notarized.
